SHERIFF’S SALE

GEORGIA, HALL COUNTY
By virtue of the Order on Plaintiff’s Motion for Judgment on the Pleadings entered by Judge John E. Girardeau, Superior Court, Northeastern Judicial Circuit, on July 2, 2004, in Civil Action File No. 01-CV-2178-C, in the Superior Court of Hall County, State of Georgia, Styled as “First American Title Insurance Co.,, Richard W. Stimson and Linda H. Stimson, Plaintiffs vs. Jerry Baugh, Debbie Diane Patterson and A. L. Tanner, Defendants”, and by virtue of the Judgment and two Writs of Fi. Fa. Out of Civil Action File No. 97-CV-1477-C, Superior Court of Hall County, in the original sums of $42,149.27 and $11,000.00 plus interest thereon as provided by law; and

Further, by virtue of the ruling of the Superior Court in said Order on Plaintiffs’ Motion for Judgment on the Pleadings in Civil Action File No. 01-CV-2178-C, as follows:

“IT IS THEREFORE ORDERED that Plaintiffs’ Motion for Judgment on the Pleadings is hereby GRANTED, and FURTHER ORDERED AND ADJUDGED: that Plaintiff’s Judgment Lien and two writs of Fi. Fa. Arising out of Civil Action No. 97-CV-1477-C in this court are superior to and have priority over the Warranty Deed from Defendant Jerry Baugh to Defendant A. L. Tanner (recorded at Deed Book 3545, pp. 115-116, in the Office of the Clerk of the Superior Court of Hall County, Georgia), as to the real property described in said Warranty Deed, and that the legal title to said real property described in said Warranty Deed is subject to Plaintiffs’ said Judgment Lien and two Writs of Fi. Fa.; the execution of Plaintiffs said two Writs of Fi. Fa. and a levy on land as against said real property in said Warranty Deed is hereby declared and approved, and the foreclosure of Plaintiffs’ said Judgment Lien as against said real property described in said Warranty Deed by levy and Sheriff’s sale according to the law, and all as against Defendants Jerry Baugh, Debbie Diane Patterson, and A. L. Tanner, as their interests or claims my appear, is hereby declared and approved; and that Defendants, jointly and severally, pay Plaintiffs all court costs in this action.”

THERE WILL BE SOLD AT PUBLIC OUTCRY to the highest bidder for cash before the Courthouse Door of Hall County, Georgia, within the legal hours of sale on the first Tuesday in November, 2009, the following described property:

All that tract or parcel of land lying and being in Hall County, Georgia, and being in Land Lot No. 3 of the 8th District of Hall County, Georgia, and being Lot No. 10 of the Subdivision of the Property of Guy M. Carter and Olin A. Williams recorded November 18, 1959, in Plat Book 23, Page 39, Hall County, Georgia; said plat is by reference made a part hereof; and as further described in that certain Quitclaim Deed from Debbie Patterson, Grantor, to Jerry Baugh, Grantee, dated April 15, 1994, and filed for recording June 13, 1994, and recorded June 14, 1994 at Deed Book 2203, Page 336, Hall County Records; and as further described in that certain Warranty Deed from Jerry Baugh, Grantor, to A. L. Tanner, Grantee, filed for recording November 23, 1999, and recorded November 24, 1999, at Deed Book 3545, Pages 115-116, Hall County Records; and being commonly known as 1585 Johnson Road, Gainesville, Georgia 30504; and being improved property with a residential structure thereon.

This Sheriff’s Sale is made in execution of said Plaintiffs’ two Writs of Fi. Fa. and is a levy on land pursuant thereto and for the purposes of payment on the said two Writs of Fi. Fa. and all expenses and costs of the sale as provided by law.

Said property will be sold subject to the following items which may affect title to said property; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Judgment Lien and two Writs of Fi. Fa. described hereinabove.

To the best of the knowledge and belief of the Plaintiffs, the party in possession of the property is A. L. Tanner or tenant (s).

THIS IS ANA ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
