(MARR) NOTICE OF SALE UNDER POWER
THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
By virtue of a Power of Sale contained in the Security Deed from SHERI K. MARR and CHARLES E. MARR dated DECEMBER 1, 2006 to LEE WALDRIP, AS TRUSTEE, LEE R. WALDRIP LIVING TRUST and recorded in Deed Book 5994 Page 463-437, Hall County, Georgia records given to secure a Promissory Note of even date in the original principal amount of Two Hundred Ninety Four Thousand Five Hundred and 00/100 Dollars ($294,500.00), with interest as provided therein on the unpaid balance until paid, there will be sold at public outcry to the highest and the best bidder for cash before the Courthouse door of Hall County, Georgia, within the legal hours of sale on the first Tuesday in December, 2008, the following described property:
All that tract or parcel of land situated and lying and being within Land Lot 155 of the 9th District, Hall County, Georgia; property known as Lot 1, Wilshire Woods Subdivision, and known as 820 Wilshire Drive., Gainesville, GA 30501. Map Code 01043 001066. As per plat of property by D. Keith Kilby, licensed surveyor, prepared for Lee Waldrip, recorded in Hall County Records, Book 853, Page 237.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees, notice of intention to collect attorneys fees having been given. The property will be sold subject to any outstanding ad valorem taxes and assessments, and to the best knowledge and belief of the undersigned, SHERI K. MARR and CHARLES E. MARR AND/OR TENANTS are in possession of said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S.Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
